Aquafy Application Terms and Conditions

1. General Provisions
- The Aquafy application (hereinafter referred to as the "Application") is owned and operated by Dawid Podolak Mobi-Software, with its registered office in 37-100 Łańcut, Poland (hereinafter referred to as the "Administrator").
- The Application is an informational and organizational tool intended for aquarium hobbyists, allowing users to keep and manage aquarium-related records.
- The Application is currently available exclusively as a mobile application for devices running the Android operating system. The Administrator may, in the future, make the Application available on other platforms, in particular on iOS, or as a web-based service.
- Use of the Application requires acceptance of these Terms and Conditions and the Privacy Policy.

2. Definitions
- Application – the Aquafy mobile application.
- User – a natural person who has created an Account in the Application.
- Account – an individual user account enabling access to the Application.
- Services – functionalities made available within the Application.
- User Content – any data, information, notes, images, or other materials entered into the Application by the User.
- Premium Features – paid functionalities of the Application that may be introduced in the future.
3. Nature and Scope of the Service
- The Application enables, in particular: a) management of aquarium information, b) logging of water parameters, c) keeping maintenance and observation logs, d) managing livestock records and photographic documentation.
- The Application does not provide advisory or professional services.
- The Application does not replace professional aquarium, veterinary, or technical expertise.
4. Technical Requirements
- To use the Application, the User must have: a) a mobile device running Android version 26 or higher, b) access to Google Mobile Services (GMS), c) an active Internet connection, d) the current version of the Application installed on the device.
- The Application is distributed exclusively via Google Play.
- The Administrator does not guarantee compatibility with devices that do not support Google Mobile Services or with alternative application stores, including those based on Huawei Mobile Services (HMS).
- If the Application is made available on other platforms, in particular iOS (minimum version 16) or as a web service, detailed technical requirements will be specified in the Application description or its documentation.
5. Registration and User Account
- Use of the Application requires creation of an Account.
- The User is required to provide accurate and up-to-date information.
- The User is responsible for maintaining the confidentiality of their login credentials.
- All actions performed using the Account are deemed to have been carried out by the User.
6. Application Features
- The scope of available features may change over time.
- The Administrator reserves the right to temporarily limit access to the Application or its features for technical or maintenance reasons.
7. User Content
- User Content remains the property of the User.
- The User grants the Administrator a non-exclusive, royalty-free license to use User Content solely for the purpose of providing the Services, including storage, display, and creation of backup copies.
- The User is solely responsible for the User Content entered into the Application.
8. Rules of Use
- The User undertakes to use the Application in accordance with applicable law, these Terms and Conditions, and the intended purpose of the Application.
- In particular, the User is prohibited from: a) entering unlawful content, b) engaging in activities that disrupt the operation of the Application, c) attempting to gain unauthorized access to the Application’s systems.
- The Administrator may restrict or block access to the Account in the event of a violation of these Terms and Conditions.
9. Advertisements
- The Application may display advertising content.
- Advertisements will be clearly marked as advertising content.
- The Administrator may introduce an option to disable advertisements as part of Premium Features or a subscription.
10. Paid Features and Subscriptions
- The Application is currently provided free of charge.
- The Administrator may introduce Premium Features or subscriptions in the future.
- Detailed information regarding prices, scope, and terms of Premium Features will be presented to the User prior to purchase.
- Payments will be processed through application distribution platforms (Google Play, and in the future, also the App Store).
11. Account Deletion
- The User may request deletion of their Account by contacting the Administrator via email.
- Deletion of the Account results in permanent removal of User data, subject to retention obligations under applicable law.
12. Liability
- The Administrator shall not be liable for decisions made by the User based on data stored in the Application.
- The Administrator shall not be liable for damages resulting from improper use of the Application.
- The Administrator’s liability is limited to the maximum extent permitted by law.
- These Terms and Conditions do not exclude or limit any consumer rights arising from mandatory provisions of law.
13. Complaints and Technical Support
- Complaints regarding the operation of the Application may be submitted via email to: contact@aquafy.app.
- Complaints will be reviewed within 14 business days.
14. Amendments to the Terms and Conditions
- The Administrator may amend these Terms and Conditions only for valid reasons, in particular due to changes in applicable law, development of the Application’s functionality, or changes in the method of service provision.
- Users will be informed of amendments via the Application or by email with appropriate advance notice.
- A User who does not accept the amended Terms and Conditions may discontinue use of the Application and delete their Account before the amendments take effect.
- Continued use of the Application after the amendments take effect constitutes acceptance of the amended Terms and Conditions.
15. Final Provisions
- These Terms and Conditions enter into force on the date of publication.
- The governing law shall be the law of the Republic of Poland.
- Matters not regulated herein shall be governed by applicable provisions of law.
